“Cloud computing” has become a very hot topic. For the uninitiated, “cloud computing” generally refers to providing access to computer software through an Internet browser, with the software and data stored at a remote location at a “data center” or “server farm,” instead of on the computer’s hard drive or on a server located on the user’s premises. This is also referred to “software as a service.”

Proponents of this approach claim many benefits, including lower costs, less need for on-site support and “scalability.” “Scalability” means that the number of licenses and available resources can easily be adjusted as the need increases. Access can typically be provided to any computer with a browser and an Internet connection, but can be controlled through password protection and other measures. Proponents also argue that the cloud makes it easier to manage and push down software upgrades. Software as a service is usually provided on a fee for service approach that may result in cost savings compared to the traditional local area network. Think of it as somewhat like renting as opposed to owning.

Cloud computing is not a technology of the future, but is here today. Google, for example, uses this approach to provide its suite of business applications intended to compete with Microsoft Office. Google applications are provided free or at very little cost. Salesforce.com is one of the best known providers, providing customer relationship management (”CRM”) software to a growing list of companies. IBM and Microsoft are also entering the playing field.

In summary the arguments in favour of the Claimant were as follows:

New court decisions are being issued on Section 230 regularly, and it is imperative that website operators understand the scope of their liability as it relates to their use of user-generated content.

However at trial, the jury after the exchange of witness statements may infer that there was substantial publication of the said items within the jurisdiction. It is also important to note that It can be claimed that publication over the Internet has taken place if and only if the material is accessed and downloaded by a third party within the jurisdiction. So if you think that you might be in an Internet dispute you need to make sure you get the evidence at the time of the offending behavior. The more evidence you can gather and store safely the stronger your case will be when you eventually end up in court

The ability to copy and distribute digital media, including text, music and images, all of which may be copyright protected, allows for infringement to occur at a seemingly unstoppable rate. As is noted by so many commentators, however, copyright holders get the benefit of having their works seen in ways and in numbers that were simply not possible before the Internet.

Music has provided some interesting lessons. Some musicians and the RIAA (Recording Industry Association of America) have aggressively pursued end-users who download copyright protected music in ways few anticipated. It used to be believed that it was simply impossible to try and stem the tide of illegal music downloads. Why try? But some in the music industry took up the challenge and devoted tremendous financial resources to pursue music copyright infringers.

In order to protect your band logo under copyright law, all you have to do is put your logo in a tangible form (on paper, on CD, on a hard drive, on the back of a candy wrapper, etc.). Once it’s in this fixed form, the creator owns the exclusive rights to produce or reproduce the art.

Although you automatically own the copyright to the logo artwork the moment it is put in a fixed form, it’s best to have taken further steps to prove to the courts that the work was originally yours should someone (perhaps another band) steal your logo or a big portion of it

As a copyright lawyer watching the market from within and representing musicians at both ends of the spectrum, I would make these observations. Every musician needs to decide for themselves which approach works best for them, but they should do so based on information. Too often, music copyright issues are addressed without properly analyzing the opportunity. Money and resources are devoted to pursuing protection against just about everyone, without considering all the options.

As a side note, do not rely on the ever-popular “Poor Man’s Copyright Method” (i.e. sending yourself your work through mail) because it is highly unlikely to hold in a court of law should someone infringe on your logo design.

Regardless of which method you choose to protect your band’s logo, remember to register it before you show it to third parties. Good Luck!

Think About Them Carefully - Online Wills

As they say, the only constant thing in life is death. All of us will, at some point, pass away. Before, people refused to think about this; choosing instead to go on with their lives until the time comes. But today, more and more people are becoming open-minded.

The truth is that when we die, we leave a lot of things (and people) behind, and it is always good to prepare for this incident. Think of it as securing your children’s futures or even just the things and properties which you will be leaving. After all, you want them to go to the proper hands, and not just end up with someone you probably didn’t even know.

Your safe deposit box.  Sorry, but think again!  If your agent does not have access to your bank safe deposit box, obviously he or she may never be able to get the living will in time so that it can be used.

Your home safe.  This is like placing your healthcare directives in the bank’s vault.  If only you have the combination to the safe, then your agent will probably never find it.

Giving it to someone unknown to your agent.  This is another way to “lose” your directives — giving the living will to someone other than your agent, without your agent’s knowledge.  Again: If your agent has no idea where the living will is, then how can he or she get it?  

Giving the original to someone at odds with your agent.  Some of you may have intra-family turmoil.  Obviously, never give your living will with someone who often fights with or is at odds with your designated agent.  Remember: The purpose of the living will is to ensure that your wishes are carried out.  PERIOD.  Your directives are not to be used in a way to be “fair” to another family member, or for any purpose other than ensuring that your wishes are followed.

You are also entitled to fill out a do not resuscitate order if you so choose to do so, this order will not allow your caregivers to put you on life support. Often times depending on the hospital and jurisdiction they will withhold do not resuscitate orders until their confirmed or simply not even recognize their legal power. Most hospitals will not perform intubations or resuscitation only when faced with these orders but they will treat infections, pump food and fluids directly into your blood stream, use pain management, and adequate comfort care are often times continued.

Online wills are inexpensive, compared to hiring a lawyer, whose professional fee may often be quite pricey. It is also very easy to create, as you will be provided a template, which you will just follow. There are very easy steps which have very specific questions to help you out. Some questions will even include suggestions to make decision making easier.

Intellectual Property (IP) assets are important to many businesses.  Proper use and protection of IP assets can increase revenue, expand product lines, provide a competitive edge and create an “innovation culture” within the company.  Here are three of the common mistakes I see when working with companies of all sizes.

Not Understanding Deadlines.  Intellectual property deadlines can be confusing and vary for different types of protection.  Patents, trademarks and copyrights have different deadlines and different requirements for protecting those IP assets.

A trademark is the intellectual property security or protection that is utilized to guard the unique features or characteristics which differentiate one product from another product. These features could consist of those things like: colors, brands, symbols, names, signs, shapes, smells and sounds.

This being said, we can clearly foresee that the better the protection of the patent is the higher the price of AIDS drugs will be. But many of AIDS drugs were developed before the TRIPS agreement, therefore not protected by this agreement. For those that are actually protected, some says (mostly the pharmaceutical companies), that this patent protection is a must because of having back the money invested for those research and will allow a pharmaceutical company to research even more; I don’t buy this argument stating that often it is governments that actually pays for most of those researches. In fact, with a program like the Scientific Research and Experimental Development (SR&ED) credit Tax given by the government, this is a very interesting incentive to Scientific Research not the reimbursement of all (100%) fees related those Scientific Research!.

Solution: Get everyone involved in the innovation process.  Encourage all personnel to identify and disclose new ideas - and reward that activity.  Create an innovation culture by encouraging everyone in your company to think creatively and support each other in this activity.

Finally, according to the VCLT that states in its s. 31 that a treaty has to be interpreted with good faith. Talking about interpretations, the first is to look at all the TRIPS itself. Another way to interpret a treaty and to enforce it even more is the recognition of the right to health as an international customs. There is also as mentioned the ICESCR where 143 countries are actually members, adding another way to enforce more effectively the right to health.
